Overview
These Terms of Service ("Terms") govern your use of services provided by Brand Merchants Network LLC ("Yucca Health," "we," "us," or "our"). By accessing or using Yucca Health’s website, platform, or services, you agree to these Terms. Please read them carefully. If you do not agree, you may not use our services.
Eligibility
- You must be at least 18 years old to use Yucca Health’s services.
- Services are available only to residents of the United States.
- By using our services, you represent and warrant that all information you provide is accurate, complete, and current.
Services Provided
- Yucca Health connects patients with licensed providers and licensed U.S. pharmacies for telehealth consultations and prescription fulfillment.
- Consultations are conducted asynchronously. Providers review your intake and may follow up through secure messaging if additional details are required.
- Yucca Health facilitates access to care but does not itself practice medicine. All medical decisions are made by licensed providers.
- Prescriptions may include compounded medications, which are not FDA-approved and do not undergo FDA review for safety, effectiveness, or manufacturing quality.
Patient Responsibilities
By using Yucca Health, you agree to:
- Provide complete and accurate medical information.
- Disclose all medications, supplements, and medical conditions.
- Use the prescribed medications only as directed by your provider.
- Maintain the confidentiality of your account and secure login credentials.
- Promptly notify Yucca Health of any suspected unauthorized use of your account.
Payment & Subscriptions
- Pricing is shared after intake once eligibility is confirmed.
- Subscriptions may be billed monthly, quarterly, or 6-month and automatically renew until the end of your six-month prescription.
- Renewals are processed 5–7 days early to ensure timely provider review, pharmacy compounding, and delivery.
- All compounded medications are final sale and cannot be returned or refunded once shipped.
- Refunds are issued only in cases of duplicate charges, billing errors, or if a provider does not approve treatment.
Pricing & Availability
- Pricing may change from time to time, and promotional discounts may be offered.
- Medication availability may vary based on pharmacy inventory and supply chain factors.
- Providers and pharmacies may substitute or adjust formulations when medically appropriate.
Shipping & Delivery
- Medications are compounded and shipped by licensed U.S. pharmacies.
- Orders typically ship within 2–3 business days of provider approval via UPS 2-Day Air.
- Deliveries are only made Monday through Friday to protect cold-chain integrity. No weekend or holiday shipments.
- Once a carrier confirms delivery, Yucca Health is not responsible for lost or stolen packages. Patients must notify Yucca Health within 24 hours of delivery confirmation if a package is missing.

Cancellations
- Orders may be canceled prior to pharmacy processing.
- If an order is in progress at the pharmacy, cancellation may be attempted but is not guaranteed.
- Once shipped, all orders are final and cannot be canceled.
Use of the Platform
- Services are provided asynchronously, and no live doctor visit is required unless specifically requested by the provider.
- You agree not to misuse the platform, interfere with operations, or attempt unauthorized access.
- Yucca Health may suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activity.
Privacy & Data Use
- Your information is collected, stored, and shared in accordance with HIPAA and applicable state privacy laws.

Limitations of Liability
- Yucca Health provides access to licensed providers and pharmacies but is not responsible for medical decisions or treatment outcomes.
- To the maximum extent permitted by law, Yucca Health disclaims liability for indirect, incidental, or consequential damages arising from your use of the services.
Indemnification
You agree to indemnify and hold harmless Yucca Health, its affiliates, employees, and contractors from any claims, damages, or expenses arising from your violation of these Terms or misuse of the services.
Dispute Resolution
- These Terms are governed by the laws of the State of California.
- Any disputes shall be resolved through binding arbitration in Los Angeles County, California.
- You agree to waive the right to a jury trial or class action lawsuit.
Changes to Terms
Yucca Health may update these Terms from time to time. Continued use of the services after changes are posted constitutes your acceptance of the updated Terms.
